Patenting the Hank Drum?

I've several builders recently describe their creations as "patent pending" or "patented". I wanted to open a discussion here about this idea, since I firmly believe that there is nothing patentable about the hank drum, since it was created by Dennis H. and released to the world as an open source design. In my interpretation, that means that everyone is free to create their own creations, but due to Dennis's prior art, you don't have a chance in heck of getting a patent.

With the exception of Larry's magnetic tuning innovation (Milltone Drums), I haven't seen anything novel enough to be patentable. [Which by the way, I would encourage any of you who've adopted Larry's Magnetic tuning idea to 1) either have a conversation with him about approval to use the idea or 2) provide hime some licensing fee and at least 3) reference Larry as the innovator.]

You can get what's called a design patent.  It's relatively inexpensive and anyone can really do it.  "A US design patent covers the ornamental design for an object having practical utility."  That's from Wikipedia. 

Just because someone invented and patented a lamp, doesn't mean you can't patent your own design of a lamp. 

One problem in proctecting your idea/ design etc..

a varation in design/ approach methodology  of 20-30% & you can apply with a good chance on that design getting protection.

I have a design patent pending for the solfege tank drum that is my idea.  I would never claim to invent the hank drum/tank drum but using it for educational purposes with music theory applications was my idea.  That is what I am protecting.

Tina - That is just plain silly.  Good luck with that.  You are not the first by a long shot.  Don't forget the inventor Dennis Havlena has used all of his instruments, including his hank drums, in exactly the same educational setting which you describe for many years.  Such a patent would put a strangle hold on the ability of teachers to enlighten students.  Can you think of none, other than yourself?

At best, about the only thing one could hope to control at this point in time is an artistic copyright.  That is, for the use of your particular aesthetic  design.

Don't forget Rock Creek.  Teaching is their whole foundation.

Dear RP Watson....You are the one that seems to be just plain silly.  In your last statement - At best, about the only thing ...... - This is exactly what I am protecting with my patent - my particular aesthetic design which is the solfege labels with the ladybug design - Maybe instead of getting so excited about telling someone off you should actually read what they are stating.  

 

My patent on my design for the drum doesn't prevent anyone from creating one just like it or using it as they wish.  Someone could change it in a small way and avoid the patent infringement....all of these things I have considered.  I am only trying to protect my creative and artistic design so that someone else doesn't profit from using my design. 

It would not prevent anyone from using the tank drum for educational purposes and put a stranglehold on anything....a bit dramatic are we?  You are rude and abrasive and shame on you for commenting to someone that is part of the same community loving the tank drum in all it's endeavors.  I applaud every variation and improvement that I see in the field....never thinking to attack anyone with a condescending tone as you have done. 

You don't know me but feel quite justified in making statements about who I care about?  The direction I have taken my design of the drum is after working with several autistic families that are benefiting from using their tank drums...there is no selfish intention in any of this.

There is no patent conflict.  I am pretty sure that Tina has (and correct me if this is wrong Tina) restated her position and wants to patent only her artistic design.  Perhaps it would be more accurate to say "copyright" the image and name of her hank drum.

Also, I enjoy your satire and commentary on the human experience.

I never mind Tina when writting, i know nothing about her. I a m sure that his way to think things like patending a common wealth is not the sign of a "bad person", i am sure that, most of américan people like most of "modern russian" and like... french socialists ... is born in the idea of conurrence like the ONLY motor of common and personnal developpement. 

This is why i make my best to write english an communicate lioke this.

I did nt kow nothing about astronomy 6 monthes ago. Just get it writting posts  on the web with a collaborative group. I had the chance, in return, to give one or two ideas to the group, it's something like (no) money back for all. These ideas where born buildin model planes or.... tanks drum. Survey the patents, they quickly travel the world and hobbies!

Free the Hank-drum ! (and all it's derivates, in any form, color, shape, tone, etc..)

When/if I want to make a lesson using a 'solfege' (pretty general term) hank-design for my kids, I will never-ever pay you a dime dear Miss 'Tina Robs'!

You speak about protection .. well I want to protect the universal right of building/using hankdrums like/when/how/where-ever anybody wants too!

The application you have found, to work with authistic persons, is honorable, and for me would be enough to make me feel good.
I would, tell anyone to do the same and use my principle of 'solfege-hank' lessons freely, for the good of the people you speak about, not for my own pocket!  .. but then again, you are not me.

.. what irritates me more, is when you put some 'social' value in the statement, by telling you're using it for autistic people, and at the same time you're preventing others with the same noble intention to do the same elsewhere .. I hope it's just because you didn't think about it, because you're far from being the only one working with people suffering from a handicap .. it's not selfish but it's just incredibly egocentric .

So "all good things come from God" including ideas leading to healing vibrations.. . Mans/womans pride never ceases to amaze me... my fathers/mothers coming to claim his /her patents back. .. hope their attorneys have been studying his/her laws ..peace to you all... I am grateful for healing Hank drums. .. flood the market. ..Aho! Endeavoring to keep the unity of spirit though the bonds of peace!
